Transcribed Will Record 1,2,3, Highland County, Ohio Probate Court:

WILL OF MARY PENN FOSTER
In the name of God amen, I Mary Foster of the County of Highland and State of Ohio being very sick and weak in body but of perfect mind and memory thanks be given unto God -- calling into mind the mortality of my body and knowing that it is appointed for all once to die, do make out and am this my last will and testament that is to say principally and first of all I give and recommend my soul unto the hands of Almightly God that gives it and my body recommended to the earth to be buried in decent Christian burial at the discretion of my Executor and as touching my worldly estate wherewith it has pleased God to bless me in this life.  I give demise and dispose of the same in the following manner and form.  First I give to my daughter Sarah Chaney one bed and my cow or the price of her.  Also I give to daughter Mary Zink two sheep. Also I give to my son Basil Foster my woollen wheel and smoothing iron.  I give my son John Foster one of my ten gallon Kettles.  Also I give to my son Benjamin Foster one dollar to be paid out of my personal estate.  I also give and demise unto my son Thomas Foster (whom I likewise constitute and make the sole executor of this my last will and testament) all and singular my lands lying and being in the state of Pennsylvania Bedford county.  I also give and devise to my aforesaid son Thomas Foster all and singular my land lying and being in the county of Highland and State of Ohio.  Also I give the remainder of my personal estate household kitchen furniture to my aforesaid son Thomas Foster to him to be freely possessed and enjoyed.  And I do hereby utterly disallow revolk and disannull all and every other former testament wills legacies bequests and execution by me in anywise before named willed and bequeathed notifying and conforming this and no other to be my last will and testaments.  In testimony whereof I have hereunto set my hand and seal this 16th day of November in the year our Lord one thousand eight hundred and twenty eight.
